1. Our Services

The Services include GPU Pods, Quick AI Tools, LoRA training, and other AI workflows. These features may generate content using open-source models and libraries. By using the Services, you acknowledge:

• GPU Pods: Dedicated virtual machines with GPUs for AI workflows. They use open-source models automatically installed. Users are fully responsible for the outputs they generate, and the Company disclaims any liability for third-party claims related to those outputs beyond license terms.
• Quick AI Tools: May include content moderation or filtering mechanisms to prevent creation of sensitive or restricted content. Users should follow all applicable policies when using these tools.
• Outputs generated in GPU Pods are stored temporarily and deleted automatically after 30 days. Users are responsible for saving any content they wish to keep.
• Users are solely responsible for all content generated through GPU Pods, Quick AI Tools, or LoRA training.
• LoRA Training: Users may fine-tune AI models. Users must ensure that all training data is lawful, appropriate, and does not infringe third-party rights.
• Some Services, including GPU Pods and certain open-source or community models, may generate uncensored, NSFW, or sensitive content. You may be exposed to adult, explicit, or sensitive material and are responsible for ensuring the content you create, view, or distribute is lawful in your jurisdiction.
• The Company does not monitor or moderate GPU Pod outputs and is not responsible for any user-generated NSFW or sensitive content.

2. Intellectual Property Rights

Our Intellectual Property

We own or license all intellectual property rights in the Services, including software, designs, content, trademarks, logos, and AI workflows ("Content" and "Marks"). You may use Content solely for personal or internal business purposes.

Open-Source Components & Models

• Some AI models and tools ("Open-Source Models") available through the Services are provided under third-party open-source licenses.
• We do not own the Open-Source Models unless explicitly stated.
• Access to Open-Source Models is provided only through the Services.
• Users are responsible for ensuring their use of models complies with open-source licenses.
• The Company is not liable for claims arising from your use, modification, or redistribution of Open-Source Models.
• All Open-Source Models are provided "AS IS" without warranty.

User-Generated Content & Submissions

Users retain ownership of content they create using the Services but must ensure compliance with all applicable laws, third-party rights, and these Legal Terms. Users agree to indemnify and hold the Company harmless from any claims or damages arising from such content. By submitting feedback, ideas, questions, or other material ("Submissions"), you grant the Company all rights to use, modify, and distribute such Submissions for any lawful purpose without compensation.

3. User Registration & Account

Users may be required to register to access certain Services. You must provide accurate information, maintain account security, and promptly update registration details. We may remove or modify usernames deemed inappropriate.

4. Purchases, Payment & Cancellation

All purchases are final, non-refundable, and non-transferable under any circumstances, including but not limited to:

• Features in beta or development
• Subscription-only features that cannot be tested with free tokens
• Service interruptions or downtime
• Features not meeting user expectations
• Technical issues or bugs
• User dissatisfaction with results or outputs
• Lack of access to trial periods for certain features

Free trial tokens are provided for evaluation of select features only. Some features, including beta features, may require an active paid subscription to access and cannot be tested before purchase.

Beta and Subscription-Only Features

• Certain Services may be labeled as "Beta," "Experimental," or "Preview," and/or may only be accessible with a paid subscription.
• Beta features are provided "AS IS" with no guarantees of functionality, performance, or availability.
• Beta features may contain bugs, errors, incomplete functionality, or may not work as expected.
• Beta features may be modified, discontinued, or removed at any time without notice or refund.
• Some features cannot be tested with free trial tokens and require a paid subscription to access.
• You are purchasing access to features in their current state, which may include incomplete or non-functional beta features.
• No refunds will be issued for beta features, subscription-only features, or any features that do not meet your expectations.
• It is your responsibility to review available documentation, feature descriptions, and limitations before subscribing.

Users authorize the Company to charge the selected payment method, including applicable taxes. Prices displayed may exclude applicable taxes unless otherwise stated. Taxes are calculated and collected automatically by our payment provider based on your billing address, location, and applicable tax regulations. Due to changes in tax laws or tax configuration, taxes may apply differently to initial purchases and future subscription renewals. By making a purchase or subscribing, you explicitly waive any right to a refund and acknowledge that all sales are final, regardless of feature availability, functionality, or performance.

5. Prohibited Activities

You may not use the Services for illegal purposes, violate third-party rights, or engage in harmful behavior. Prohibited activities include, but are not limited to:

• Hacking, reverse engineering, or disrupting the Services
• Using automated bots or scripts without explicit permission
• Generating illegal, unsafe, or restricted content using GPU Pods, Quick AI Tools, or LoRA training
• Creating, uploading, generating, or distributing illegal sexual content, including content involving minors or non-consensual acts
• Generating explicit or pornographic content where prohibited by applicable law
• Violating intellectual property rights of third parties
• Collecting user data for unsolicited marketing or spam
• Impersonating other users or Company personnel
• Attempting to bypass moderation, safety, or access restrictions

6. Storage and Data Handling

GPU Pod outputs are stored temporarily for 30 days. Quick AI Tools outputs are stored according to platform policies. Users are responsible for retaining outputs they wish to keep. We are not liable for data loss, corruption, or deletion.

7. Liability & Indemnification

The Services are provided "AS IS" without warranties. Users acknowledge that content generated by AI tools, including open-source models, may not be accurate, lawful, or appropriate. The Company is not liable for any damages, claims, or losses arising from the use of Services.

Users agree to indemnify and hold the Company harmless against any claims arising from:

• Violation of third-party rights
• Use of open-source software beyond its license terms
• User-generated content or models
• Unauthorized or prohibited use of the Services

8. Content Moderation

GPU Pods provide full freedom for content generation without automated moderation. Quick AI Tools may include moderation or filtering mechanisms. Users must comply with all applicable laws and policies when using any part of the Services.

9. NSFW & Sensitive Content Disclaimer

Some Services may generate adult, explicit, uncensored, or otherwise sensitive content. By accessing or using these Services, you agree that:

• You must be at least 18 years old to access or generate NSFW content
• You are solely responsible for ensuring that any NSFW or explicit content you generate complies with all applicable laws and regulations in your jurisdiction
• The Company does not endorse, monitor, or distribute NSFW content and provides uncensored models solely for lawful creative, artistic, and research purposes
• The Company is not responsible for user-generated NSFW content under any circumstances

10. Governing Law & Jurisdiction

These Legal Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or the Services will be subject to the exclusive jurisdiction of courts in the Netherlands.
